Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Nautog, including our mobile application(s), website at nautog.com, and related subscription and account services (together, the "Service"), operated by us ("Nautog", "we", "us", "our").

By creating an account, downloading or using the app, or using our website, you agree to these Terms. If you do not agree, do not use the Service.

2. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

3. The Service

Nautog provides tools to log voyages and passages, track maintenance and engine-related information, and manage vessel-related records. Features may differ between free and paid ("Pro") plans. We aim to keep the Service available and accurate but do not guarantee uninterrupted, error-free, or complete operation.

The Service is not a substitute for professional maritime, navigation, or safety advice, or for official logbooks or records required by law or regulation. You are solely responsible for safe operation of your vessel and compliance with applicable laws.

4. Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must be legally able to enter a binding contract in your jurisdiction. We may suspend or terminate accounts that breach these Terms or pose risk to the Service or others.

5. Subscriptions and payments

Nautog Pro or other paid features may be offered via in-app purchase (Apple App Store / Google Play) and/or our web billing partner (e.g. Stripe). Fees, renewal, and cancellation are as shown at purchase and in the relevant store or checkout flow. Refunds follow the policies of the applicable payment provider and store where you subscribed.

6. Your content and licence

You retain ownership of content you submit (e.g. passage notes, vessel data). You grant us a non-exclusive, worldwide licence to host, store, process, back up, and display that content only to operate and improve the Service for you (including sync and reminders where enabled).

Use of anonymised or aggregated data for research is described in our Privacy Policy.

7. Acceptable use

You must not misuse the Service (including attempting to access others' data, interfere with infrastructure, reverse engineer except as permitted by law, or use the Service unlawfully). You must not upload unlawful, harmful, or infringing content.

8. Intellectual property

Nautog name, branding, software, and materials are protected by intellectual property laws. Except for the licence to your content above and your right to use the Service as offered, we do not grant you rights in our IP.

9. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms limits those non-excludable rights. Where we are permitted to limit liability, our liability is limited to the maximum extent allowed by law (including resupply of the Service or payment of the cost of resupply).

10. Disclaimer and limitation

To the fullest extent permitted by law, the Service is provided "as is". Except for non-excludable rights, we exclude liability for indirect or consequential loss, loss of data, or reliance on the Service for navigation or safety decisions. Your use of the Service is at your own risk.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, legal requirements, or operational reasons, with notice where reasonable. Provisions that by nature survive (e.g. liability limits where permitted, governing law) survive termination.

12. Changes

We may update these Terms from time to time. We will post the updated version and revise the "Last updated" date. Continued use after changes constitutes acceptance where permitted by law. Material changes may require additional notice under applicable rules.
